The Notice of Intent summarizes the case – the facts, basis for the case, and the defendants. It must be accompanied by an expert affidavit and standard disclosure demands.

Once the Notice is served, parties may subpoena medical documents. They must participate in mediation. If mediation is unsuccessful, the plaintiff may proceed to formally file the case.

After filing, the case proceeds through the traditional case process. The parties may still resolve the case by settlement or trial.

Government (SC Code § 15-78-120)

Charitable organizations (SC Code § 33-56-180, § 15-78-120)

Nursing home abuse claims against charitable organizations are subject to SC Tort Claims Act limitations – $300,000 per occurrence, per entity, and $600,000 total per occurrence. When the claim involves a government entity and a licensed physician or dentist, up to $1.2 million may be awarded. Punitive damages and exemplary interest are not awarded.
